1. Definitions
"We", "us" and "Gladiator Peptides" mean the supplier of the products. "You" and "Buyer" mean the person or entity placing an order. "Products" means the research compounds and consumables listed on this website. "Research-Use Policy" means the policy published at /research-use.html.
2. Eligibility
You may place an order only if you meet every condition set out in section 3 of the Research-Use Policy — including that you are 21 or over, are a qualified researcher or acting under the direction of one, and are purchasing on behalf of a research entity. We may require documentary evidence before dispatch and may refuse or cancel any order at our discretion.
3. Orders and acceptance
Product listings are an invitation to treat, not an offer. Your order is an offer to purchase, which we accept only when we dispatch the goods. We may decline an order for any reason, including unavailability, pricing error, failed verification, or where we believe the intended use is inconsistent with the Research-Use Policy. Where we decline an order after payment, we refund in full.
4. Pricing and payment
Prices are in US dollars and exclude shipping, duties and taxes, which are shown or calculated at checkout. We correct obvious pricing errors and will contact you before proceeding where a listed price was manifestly wrong.
Payment is due in full before dispatch, except for verified institutional accounts operating on agreed net terms. We accept card, bank transfer against a purchase order, and selected cryptocurrencies. Cryptocurrency payments are final once confirmed on-chain; refunds are issued in the original cryptocurrency at the prevailing rate at the time of refund, and we do not bear exchange-rate risk.
5. Delivery and risk
Delivery estimates are estimates, not guarantees, and exclude time held in customs. Risk in the products passes to you on delivery to the address you supplied. Title passes on receipt of payment in full.
You are responsible for supplying a correct and complete delivery address, and for ensuring someone is available to receive the shipment where a signature is required. Reshipment following a failed delivery caused by incorrect address details is chargeable.
6. Import compliance
You are solely responsible for confirming that the products may lawfully be imported into, possessed in and used within your jurisdiction, and for paying any duties, taxes or import charges. Shipments seized, detained or refused entry by customs are not refundable where you failed to verify local requirements before ordering.
7. Returns
Returns are governed by our Shipping & Returns policy. In summary: unopened vials with an intact seal are returnable within 30 days with prior authorisation; opened vials are not returnable; and material that fails to meet its certificate of analysis is refunded or replaced in full regardless of whether it has been opened.
8. Warranty
We warrant that, at the time of dispatch, each product conforms to the specifications stated on the certificate of analysis issued for its lot. This warranty is our entire warranty and is given only to the original buyer.
To the fullest extent permitted by law, we give no other warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. In particular, and without limitation, we give no warranty whatsoever that any product is safe, effective, or suitable for administration to any human or animal, such use being expressly prohibited.
The warranty does not cover degradation arising from storage or handling after delivery. Our storage guidance sets out the conditions under which the stated stability applies.
9. Limitation of liability
Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.
Subject to that, our total aggregate liability arising out of or in connection with any order — whether in contract, tort (including negligence), breach of statutory duty or otherwise — is limited to the amount you paid for the products giving rise to the claim.
We are not liable for indirect or consequential loss, loss of profit, loss of data, loss of research time, cost of repeated experiments, or any loss arising from use of the products otherwise than in accordance with the Research-Use Policy.
10. Indemnity
You agree to indemnify and hold us harmless against all claims, damages, losses and costs (including reasonable legal fees) arising from your breach of these terms or of the Research-Use Policy, from any use of the products by you or by any person to whom you supply them, and in particular from any administration of the products to a human or animal.
11. Intellectual property
All content on this website — text, design, artwork, code and data — is owned by or licensed to us and may not be reproduced without written permission. Sale of a product conveys no licence to any patent, and it is your responsibility to determine whether your intended use infringes any third-party rights.
12. Privacy
Personal data is handled in accordance with our Privacy Policy.
13. Force majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier disruption, customs action, regulatory change, supply failure, natural events or acts of government.
14. Changes to these terms
We may amend these terms at any time. The version in force at the time you place an order governs that order. Material changes are reflected in the effective date at the top of this page.
15. Governing law
These terms are governed by the laws of the State of Delaware, USA, and the courts of that state have exclusive jurisdiction, without prejudice to any non-excludable consumer rights available to you under the law of your country of residence.
16. Entire agreement
These terms, together with the Research-Use Policy, Shipping & Returns policy and Privacy Policy, constitute the entire agreement between us and supersede any prior discussion or representation. If any provision is held unenforceable, the remainder continues in force.
